These terms are an agreement between ClearPath Insights LLC ("ClearPath," "we") and the business identified on your subscription or invoice ("you" or "your agency"). By subscribing or signing in, you agree to them.
ClearPath Renewal Intelligence delivers monthly lists of businesses, built from public records and other publicly available sources, through a signed-in website. A subscription covers the lists and territory named on your invoice, plus any companion features included with them. Unless your invoice states that a list is exclusive, we may provide the same or similar lists for that territory to other customers.
These terms are for businesses using the lists in their own sales work. Carriers, MGAs, lead resellers and marketing organizations need a separate agreement.
Sign-in is by a one-time code emailed to an approved address. You may add as many people from your own agency as you like. Sign-in access is for your agency's employees only; don't share codes or access with anyone outside it. Tell us if you believe someone has signed in without permission.
The lists are for your agency's own prospecting and client service. You may not:

The underlying public records may be available from their original sources. ClearPath keeps all rights in how those records are collected, organized, matched, enriched, scored, presented and delivered through the service. Your subscription gives you a limited, non-transferable right to use the service under these terms, not ownership of it.
Our lists are compiled from public records and other publicly available sources, which can be incomplete, delayed or wrong. We work to keep them accurate, but we provide them "as is," without any guarantee that any record is complete, current or correct. Verify anything important before relying on it, including coverage status, dates and contact details.
We also don't guarantee results. A business on a list may not respond, change providers, buy insurance or produce any particular sale.
You are responsible for how you contact anyone on a list. That includes following telemarketing, do-not-call, texting and email laws, and insurance licensing and solicitation rules that apply to you.
If a claim is brought against ClearPath because of how you used the lists, or because you broke these terms, you agree to defend ClearPath and cover its resulting costs, including reasonable legal fees.
Subscriptions are billed monthly in advance. Your first payment is due before access begins, and each list renews on the 1st of the month. Invoices and receipts are emailed, and you can update your payment method or download invoices any time from the billing link on your home page. Prices don't include taxes; if any apply, they're added to your invoice.
If you have a billing problem, contact us first. Disputing a charge with your bank instead may pause access while it's resolved.
Founding and other promotional pricing, and any features included with it, apply for the period shown on your invoice. After that, the standard price shown on your invoice applies.
If a payment fails, access to your lists is paused until it's resolved, and restored automatically once it's paid. Bank payments that are still processing don't count as failed. If a payment is still unresolved 14 days after access is paused, we may release your list to another agency.
Email steve@clearpathinsights.io to cancel. To avoid the next monthly charge, we need your cancellation before your next billing date. Access continues until the end of the period you've paid for, and payments already made aren't refunded.
The notes and call outcomes you record are yours. You can export or delete them whenever you want. After you cancel, we keep them for 12 months so you can pick up where you left off if you return, then delete them automatically, or sooner if you ask. We don't review the content of your notes except when needed to provide support, maintain the service, investigate a security issue or comply with the law.
We may suspend or end access if payment isn't made (section 8) or if the lists are used in a way these terms don't allow (section 3). If we stop offering the service, we'll give you at least 30 days' notice and refund any payment covering the period after it ends.
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost sales, lost profits or lost business opportunities. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
We may update these terms. We'll email you at least 30 days before a change takes effect; continuing to use the service after that date means you accept it.
These terms are governed by the laws of Wisconsin. Any dispute will be handled in the courts of Waukesha County, Wisconsin.
